The constitution it's the supreme normative document of a political system and the reflection of all the laws of a state, sits in the top of the legal system of societies and regular all the existing relations in a political system that often or after the independence of societies and emancipated from the colonial of other governments, or after the massive and deconstructive revolutions and massive transformations of the people, a landmark as the achievement of the revolution of the people has been on the page of paper and has been the basis of the community's behavior. However, at the outset of the emergence of a new constitution, the important question that comes to mind is how the framework and the normality of power and relationships in society must be regulated. Looking at the history of the emergence of the constitution, it can be seen that the constitution has gone into compilation of existents is the more acceptable and it's more comfort in implementation, because it's according to the general theory governing its own society. in this article, by studying library resources and using the analytical method, descriptions of the people's want and accept the existents and reflected in the text of constitution and after that govern according this text it's our hypothesis for crossing of the legally government to legitimacy government have been explained in these papers.
