Legal entities are divided into two types: private law entities and public law entities. Legal entities include public law, government, and independent public institutions. Thus, the executive branch (government in a specific sense), legislative branch, municipalities, each of the ministries, all government agencies such as the Regional Water Authority, the Environmental Protection Agency, the Registry, all fall under the jurisdiction of public rights. .
Prior to the enactment of the Islamic Penal Code of 2013, the Islamic Republic of Iran's criminal law policy on criminal liability of legal persons was silent, which led to the absolute immunity of legal persons, especially government, from criminal responsibility, but in addition to accepting responsibility Criminalization of Legal Persons As a general theory, it also paved the way for criminal liability of public legal entities in the field of jurisdiction. But the legislature's criminal law policy in both the Penal Code Act 1355 and the Penal Code Act 1976 explicitly recognizes the government's exercise of sovereignty and responsibility.
