Iran's criminal policy against forgery in notaries
Forgery is one of the most important and complex criminal offenses against public safety and security, so that this action will have effects such as the invalidating official documents and the loss of public trust. In addition, it causes fear and anxiety in society and as a result, it destroys economic and social affairs and it inflicts material and spiritual damage on the people.
Official documents prepared and recorded by the head of the notary's office and its staff, if they are intentionally forged by such people, or be regulated and registered against the legal regulations, such persons will also be subject to the provisions of Articles 100 and 103 of the Law on the Registration of Deeds and Real Estate and As forgers in official documents, they will be sentenced to forgery in official documents.
Therefore, in enforcing the penalties provided for, in the existing laws, Iran's criminal Legislative policy in the occurrence of the crime of forgery by notaries did not have an effective preventive effect. Therefore, the absence of an efficient law will make it possible to infringe and escape punishment. However, the legislature is obliged to change such punishments and impose a heavier punishment in accordance with the economic and social conditions. Because forgery of official documents is one of the crimes that will directly and indirectly harm the society and the people of the society.
