E-litigation is one of the requirements of modern litigation and an important step towards the principle of speed and transparency in judicial proceedings. In this study, which examines the benefits of litigation in line with the principle of transparency, using the laws of Iran and the United States, the need for access to documents except for prohibited cases, filing and electronic proceedings, as well as transparency in the discussion of costs, has been specified. Cases such as substantive electronic litigation and virtual testimony are examples of the principle of speed, which is discussed elsewhere. Finally, the findings of this study, which are comparative between the civil litigation system of Iran and the United States, with a descriptive-analytical method, the need to review and predict the first necessity mentioned in Iranian law relative to the United States and study the implementation method. - Increases access to US courts known as pacer, along with transparency in the discussion of civil litigation costs.
